In his decision Judge Donald Floyd sail that the continuance is not sought for purposes of delay but so that justice can and will be done. The working conditions involved the use of asbestos fiber which resulted in a fatal disease called mesothelioma and this lead to his death in late 70s. According to his son his father was not provided with the basic needs that any individual should need in the asbestos related workplace.
